This Terms and Conditions Agreement (hereinafter referred to as the “Terms”) governs all use and access of the mobile application known as Sanatan™ (hereinafter referred to as the “Application” or “App”), including all features, functionalities, content, services, and offerings made available therein.
Acceptance of Terms: By downloading, accessing, or using the Application in any manner, including but not limited to registering an account, browsing content, engaging with the Sanatan AI assistant, or utilizing any of the horoscope, kundli, panchang, or wisdom video features, you acknowledge that you have read, understood, and agreed to be bound by these Terms, along with our Privacy Policy and any other legal notices or supplemental terms that may from time to time be incorporated herein by reference. If you do not agree with these Terms, you are expressly prohibited from using the Application, and you must discontinue use immediately.
The Application is made available for download through authorized distributors including but not limited to the Google Play Store and the Apple App Store, and these distributors may impose their own terms and policies applicable to your use of their platforms. By installing or using the Application, you further agree to be bound by the relevant distributor’s applicable terms of service.
1. Eligibility and User Acknowledgment:
1.1 The Application is intended solely for use by individuals who have attained the age of eighteen (18) years or older. By registering for or using the Application, you represent and warrant that you are at least eighteen (18) years of age and possess the legal capacity to enter into this binding agreement.
2. User Registration and Account Security:
2.1 In order to access the primary features of the Application, you will be required to register by providing a valid email address and creating a password. You agree to provide accurate, complete, and updated information at the time of registration and to maintain such accuracy throughout your use of the Application. You are solely responsible for maintaining the confidentiality of your login credentials, and you agree not to share your account details with any third party or permit unauthorized access to your account.
2.2 You further acknowledge and agree that you are solely responsible for all activity conducted through your account, regardless of whether such activity was expressly authorized by you. In the event of any suspected or actual unauthorized use of your account or any other breach of security, you agree to promptly notify us at the contact details provided in these Terms. The Company shall not be liable for any damages or losses resulting from your failure to maintain the security of your account.
2.3 We reserve the right to suspend, restrict, or terminate your account in our sole discretion if we reasonably believe that you have violated these Terms, provided false or misleading information, or engaged in conduct detrimental to the integrity of the Application or to other Users.
3. Intellectual Property Rights:
3.1 Unless otherwise indicated, all content, software, source code, graphics, designs, text, videos, logos, trademarks, service marks, and other intellectual property displayed on or contained within the Application are owned by or licensed to us, and are protected under United States copyright, trademark, and other applicable intellectual property laws.
3.2 The Application also contains proprietary artificial intelligence (“AI”) technology, including but not limited to the Sanatan™ AI chat assistant, AI generated astrological insights, AI-generated wisdom videos. All such content is either the exclusive property of the Company or lawfully licensed for our use. These works, whether AI-generated or otherwise, are provided solely for your personal and non-commercial use.
3.3 You are granted a limited, non-exclusive, revocable, non-transferable license to access and use the Application and its content strictly in accordance with these Terms. You may not reproduce, distribute, publicly display, publish, sell, license, or exploit any content from the Application for commercial purposes without our prior written consent. Any unauthorized use of the Application or its content constitutes a material breach of these Terms and may subject you to civil or criminal liability.
4. Application Features and Services:
4.1 The Application is a multi-functional platform designed to provide Users with astrology-based content, AI-generated insights, and spiritual wisdom. The Application presently consists of four primary sections, as described below:
4.1.1 The Home Section contains an artificial intelligence assistant named “Sanatan AI.” This assistant allows you to engage in interactive chat. This feature is designed to provide spiritual insights, cultural knowledge, and general guidance in an engaging manner. While the AI strives to provide informative and culturally enriched responses, you acknowledge and agree that its content is generated algorithmically and is intended for entertainment, cultural, and educational purposes only, and not as professional advice of any kind.
4.1.2 The Horoscope Section provides personalized astrological content, including daily horoscopes, panchang details, and personalized kundli readings based on the information you provide. This section displays zodiac signs, including their Vedic equivalents, and generates personalized cards displaying your daily horoscope and other astrological outputs. By using this feature, you consent to providing certain personal details such as your date, place, and time of birth. While reasonable efforts are taken to ensure the accuracy of generated charts, you acknowledge that astrological calculations are subject to interpretive methodologies and that no guarantee of scientific accuracy or reliability is made.
4.1.3 The Wisdom Section hosts a curated library of AI-generated educational and entertainment videos related to astrology, philosophy, and spirituality. The content provided in this section is intended to promote awareness and education in spiritual sciences and is not to be considered professional advice or an authoritative statement on astrology.
5. User Representations and Responsibilities:
5.1 By registering for and using the Application, you expressly represent and warrant that all information provided by you during registration and throughout your use of the Application is accurate, current, and complete to the best of your knowledge. You agree that you will not access the Application for any unlawful purpose, nor will you use the Application to transmit, upload, or disseminate any harmful, defamatory, obscene, infringing, or otherwise unlawful material.
5.2 You further agree that you will not attempt to reverse engineer, decompile, or otherwise interfere with the Application’s source code, functionality, or security measures. You may not use automated systems, bots, scripts, or data scraping tools to extract or harvest content from the Application. Any violation of these obligations will result in immediate termination of your account and may expose you to civil and criminal liability under applicable law.
6. Prohibited Activities:
6.1 You agree that your use of the Application shall be lawful, respectful, and consistent with the purposes for which the Application has been made available. You expressly agree that you will not engage in any conduct or activity that may compromise the integrity, security, or functionality of the Application, nor will you attempt to disrupt the experience of other Users. Prohibited activities include but are not limited to attempting to access the Application through automated means such as bots, spiders, or scrapers; interfering with security features including those designed to prevent unauthorized copying of content; introducing viruses, trojans, worms, or any other malicious code into the Application; or attempting to impersonate another User, whether for fraudulent purposes or otherwise.
6.2 You further agree not to exploit the Application for any commercial purpose without our express written consent. This includes refraining from reselling or redistributing the Application’s content, using the Application to advertise or solicit products or services without authorization, or systematically collecting information about Users for commercial gain. You acknowledge that any attempt to misappropriate intellectual property, misuse our AI technology, or circumvent restrictions placed upon access to the Application shall constitute a material breach of these Terms.
6.3 Violations of this section may result in the immediate suspension or termination of your account, without prior notice, in addition to the pursuit of all remedies available to us under applicable law, including injunctive relief and monetary damages.
7. User Content and License Grant:
7.1 The Application may permit you to submit information, suggestions, feedback, or other materials (collectively “User Content”), particularly when generating personalized astrological outputs or providing optional feedback on features. By submitting any such User Content, you grant to the Company a worldwide, royalty-free, perpetual, non-exclusive, transferable, and sublicensable license to use, reproduce, distribute, display, adapt, and otherwise exploit such content for purposes connected with the operation and improvement of the Application.
7.2 You represent and warrant that you own or otherwise control all rights necessary to grant the foregoing license, and that your User Content does not violate or infringe upon the intellectual property, privacy, publicity, or other rights of any third party. You further warrant that your User Content is not unlawful, defamatory, obscene, threatening, abusive, or otherwise offensive. The Company retains the right, but not the obligation, to remove any User Content in its sole discretion, without prior notice, if such content is found to violate these Terms or applicable law.
7.3 You acknowledge that the Company has no obligation to store or back up User Content and that it may be deleted permanently upon the termination of your account. You further waive any claims against the Company for the removal or deletion of your User Content.
8. Privacy and Data Handling:
8.1 We respect your privacy and are committed to safeguarding your personal information. All personal data collected through the Application, including but not limited to registration details, birth information provided for kundli generation, or preferences for horoscope readings, will be handled in accordance with our Privacy Policy, which is hereby incorporated into these Terms by reference.
8.2 By using the Application, you consent to the collection, storage, and processing of your personal information in accordance with our Privacy Policy. You acknowledge that although we employ industry-standard security practices, no method of transmission or storage is completely secure, and we cannot guarantee absolute security of your data. You agree that your use of the Application constitutes acceptance of this inherent risk.
9. Third-Party Services and Links:
9.1 The Application may incorporate services or content provided by third parties, including but not limited to distribution platforms such as Google Play Store and Apple App Store, analytics providers, or cloud service providers. While we endeavor to work only with reputable partners, we do not own or control the policies and practices of such third parties. Any access to or reliance upon third-party content is at your sole risk, and you agree that we are not liable for the acts or omissions of such third parties.
9.2 Where the Application contains links to external websites or content, such links are provided solely as a convenience to you and do not constitute an endorsement by us. You acknowledge that such websites are subject to their own terms of service and privacy policies, and you agree to review and comply with those terms when accessing third-party platforms.
10. Disclaimers:
10.1 The Application is provided to you strictly on an “as-is” and “as-available” basis. To the fullest extent permitted by applicable law, we disclaim all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. For registered users, Company warrants that it will use commercially reasonable efforts to provide the services in a professional and workmanlike manner. If there are defects in the App, Company will use commercially reasonable efforts to promptly correct them.
10.2 You acknowledge that the horoscope, kundli, panchang, and other astrological content generated within the Application are intended solely for entertainment and educational purposes. Astrology is not a science, and its interpretations are inherently subjective. No part of the Application’s content should be relied upon as professional advice in the fields of medicine, law, finance, or otherwise. Any decisions you make based upon information derived from the Application are made at your sole discretion and risk.
10.3 We make no representation or warranty that the Application will be free from errors, interruptions, viruses, or security breaches, nor that its content will always be accurate, reliable, or up to date. You agree that your use of the Application is undertaken entirely at your own risk.
11. Limitation of Liability:
To the maximum extent permitted under applicable law, neither we nor our officers, employees, contractors, or affiliates shall be liable to you or any third party for any direct, indirect, consequential, incidental, exemplary, or punitive damages arising from your use of or inability to use the Application, including but not limited to loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages.
12. Modifications, Suspension, and Termination:
12.1 We reserve the right to modify, suspend, or discontinue the Application, or any portion thereof, at any time without notice. We may from time to time amend these Terms to reflect updates to the Application, changes in law, or other business considerations. Such modifications will be effective immediately upon posting of the updated Terms within the Application. Your continued use after such posting shall constitute your acceptance of the revised Terms.
12.2 We may terminate or suspend your account, with or without notice, in our sole discretion, if we reasonably believe that you have violated these Terms or engaged in conduct that is harmful to us, other Users, or the integrity of the Application. Upon termination, your right to access the Application shall immediately cease, and all licenses granted to you under these Terms shall terminate.
13. Governing Law:
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Washington, without regard to its conflict of law provisions.
14. Dispute Resolution:
14.1 In the event of any dispute, controversy, or claim arising from or relating to these Terms or your use of the Application, the parties agree to first attempt to resolve such dispute informally by providing written notice to the other party and engaging in good-faith negotiations for a period of no less than thirty (30) days.
14.2 If the dispute cannot be resolved informally, it shall be submitted to final and binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association (AAA). The arbitration shall be conducted in Washington State, unless the parties mutually agree otherwise. Judgment on the arbitration award may be entered in any court having jurisdiction.
15. Force Majeure:
We shall not be held responsible or liable for any delay or failure in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, wars, riots, governmental actions, labor disputes, or network outages. In such circumstances, our obligations shall be suspended for the duration of the event giving rise to the delay.
16. Miscellaneous Provisions:
16.1 These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the Application. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision shall not be deemed a waiver of such right or provision.
16.2 You may not assign or transfer your rights or obligations under these Terms without our prior written consent, whereas we may freely assign or transfer our rights and obligations without restriction. These Terms shall be binding upon and inure to the benefit of the parties, their successors, and permitted assigns.
16.3 Nothing in these Terms shall be construed as creating any agency, partnership, joint venture, or employment relationship between you and us. You agree that these Terms will not be construed against us by virtue of having drafted them.
